Official Rules

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

1. Sponsor

The Enjoy Summer the Marin Way Sweepstakes (“Sweepstakes”) is sponsored by TFSC, Inc (Free Spirits), 936 B 7th Street, Suite 125, Novato, CA 94945 (“Sponsor”).

Tommy Breeze and Live Water Surf & Skate have contributed prizes to the Sweepstakes but are not sponsors or administrators of the Sweepstakes.

2. Eligibility

The Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia who are twenty-one (21) years of age or older at the time of entry.

Employees, officers and directors of Sponsor and the prize providers, and members of their immediate families or households, are not eligible to enter.

Void where prohibited by law.

3. Sweepstakes Period

The Sweepstakes begins when the Instagram post announcing the Sweepstakes (“Sweepstakes Post”) is published and ends at 11:59 p.m. Pacific Time on August 23, 2026 (“Sweepstakes Period”).

4. How to Enter

During the Sweepstakes Period:

  1. Follow @drinkfreespirits, @tommybreeze and @livewater_surfskate on Instagram;
  2. Like the Sweepstakes Post;
  3. Reshare the Sweepstakes Post using Instagram’s native sharing or repost functionality; and
  4. Comment on the Sweepstakes Post and tag two (2) friends.

Limit one (1) entry per person. Multiple comments, shares or Instagram accounts will not result in additional entries.

Entrants with private Instagram accounts may be required to provide reasonable proof that the required reshare was completed.

Automated, fraudulent, incomplete or otherwise noncompliant entries are void.

5. Prizes

Three (3) winners will each receive one (1) prize package consisting of:

  • One (1) 750ml bottle of Free Spirits The Spirit of Tequila;
  • Two (2) Free Spirits Margarita four-packs;
  • One (1) Tommy Breeze 415 Curved-Brim Trucker Hat; and
  • One (1) Live Water Surf & Skate Surf T-shirt.

The approximate retail value (“ARV”) of each prize package is $137. The approximate total ARV of all prizes is $411.

Apparel size, color and style are subject to availability. Prizes are non-transferable and may not be redeemed for cash. Sponsor may substitute a prize or prize component with one of equal or greater value if the advertised prize becomes unavailable.

Any federal, state or local taxes associated with a prize are the sole responsibility of the winner.

6. Winner Selection and Odds

Three (3) potential winners will be selected at random from all eligible entries received during the Sweepstakes Period on or about August 24, 2026.

Odds of winning depend on the number of eligible entries received.

7. Winner Notification and Verification

Potential winners will be contacted by direct message from the verified @drinkfreespirits Instagram account.

Each potential winner must respond within three (3) business days of notification and may be required to provide their full name, mailing address, age or date of birth, and other information reasonably necessary to verify eligibility and fulfill the prize.

A potential winner is not an official winner until eligibility has been verified by Sponsor.

If a potential winner cannot be contacted, does not respond within three (3) business days, is ineligible, declines the prize or fails to comply with these Official Rules, the prize will be forfeited and Sponsor may select an alternate winner at random from the remaining eligible entries.

Sponsor will never require payment or financial information to claim a prize. @drinkfreespirits is the only Instagram account that will contact potential winners on Sponsor’s behalf.

8. General Conditions

Sponsor reserves the right to disqualify any person who tampers with the entry process, submits fraudulent entries, violates these Official Rules or otherwise interferes with the fair administration of the Sweepstakes.

If fraud, technical failures, platform disruptions or other circumstances beyond Sponsor’s reasonable control affect the integrity or proper operation of the Sweepstakes, Sponsor reserves the right to suspend, modify or terminate the Sweepstakes and, if appropriate, award the prizes from among eligible entries received before the affected event.

Sponsor’s decisions regarding eligibility, winner selection and administration of the Sweepstakes are final, subject to applicable law.

9. Release and Publicity

To the fullest extent permitted by law, by entering, entrants agree to release and hold harmless Sponsor, Tommy Breeze, Live Water Surf & Skate, Instagram, Meta Platforms, Inc., and their respective affiliates, officers, directors, employees and agents from claims arising from participation in the Sweepstakes or the acceptance, possession or use of a prize.

Except where prohibited by law, acceptance of a prize constitutes permission for Sponsor to use the winner’s first name, city and state, and/or Instagram handle to announce the winner without additional compensation.

10. Privacy

Personal information collected from potential winners will be used solely as reasonably necessary to administer the Sweepstakes, verify eligibility and fulfill prizes, in accordance with applicable law and Sponsor’s privacy practices.

11. Instagram Disclaimer

By entering, each entrant completely releases Instagram from any responsibility relating to this Sweepstakes.

This Sweepstakes is not sponsored, endorsed, administered by, or associated with Instagram or Meta Platforms, Inc. Any questions, comments or complaints regarding the Sweepstakes should be directed to Sponsor and not to Instagram.

12. Winners List

To request the names of the winners, send a written request to: Enjoy Summer the Marin Way Sweepstakes Winners List, TFSC, Inc., 936 B 7th Street, Suite 125, Novato, CA 94945. Requests must be received within sixty (60) days after the end of the Sweepstakes Period.
